Private trees

We don't inspect or undertake works on trees growing from private property. The management of private trees is the responsibility of the property owner.

Overhanging trees and vegetation

Vegetation growing onto a road or footpath can be a problem for pedestrians and drivers. If the vegetation is growing from a private property, the property owner is responsible for it.

Vegetation includes trees, hedges and shrubs. Property owners are responsible for making sure vegetation doesn't:

  • extend beyond the property boundary and grow over public footpaths and right-of-ways.
  • obstruct the view of drivers.

Under the Local Government (Highways) Act, we can issue a property owner with a written request to fix overhanging vegetation. Property owners are given a timeframe to address the overhanging vegetation. If the property owner fails to do so, we may carry out the work and invoice the property owner.
